340B Health has an immediate opening for a General Counsel at our growing non-profit health care trade association to lead the 340B Health Legal & Regulatory Department. This position reports directly to the President and Chief Executive Officer and serves on the Leadership Team.
As the leading trade association for hospitals that participate in the 340B drug pricing program, 340B Health plays a critical role in educating and informing policy makers and key constituencies on the vital role that 340B drug pricing plays in assisting hospitals to serve low income populations. 340B Health also serves as the leading organization to educate hospital members about the ever-changing 340B regulatory landscape and compliance requirements.
The General Counsel will lead and direct the legal and regulatory department, including working closely with the CEO on strategic planning for the organization’s legal and regulatory priorities. The General Counsel will lead 340B Health relating to various public policy and legal issues before federal and state governments, including, but not limited to, HRSA, CMS, and state Medicaid agencies. This position also works closely with 340B Health member hospitals on matters relating to compliance with 340B requirements and other legal initiatives, including providing one-on-one guidance as well as leading large-scale compliance-related projects.
Develop, execute and oversee the Department’s implementation of 340B Health’s legal and advocacy agenda.
Advocate and serve as spokesperson to executive agencies and other key stakeholders and organizations, including, but not limited to CMS, HRSA, DOJ, FDA, FTC and state Medicaid agencies
Oversee development of research, using internal resources and external consultants, to support advocacy and further policy development.
Oversee the development and delivery of two annual 340B Health Coalition conferences per year, and support the development and delivery of webinars, roundtables, other events. Represent 340B at conferences and other events held by associations and other 340B stakeholders
Track closely developments around regulatory, policy and compliance matters, and provide appropriate communication to members regarding including written tools, articles, and best practices
Provide one-on-one advice to members around regulatory and compliance requirements
Closely follow all matters affecting the 340B drug pricing program
Conduct legal, regulatory and legislative research
Collaborate and develop relationships with outside organizations
Manage and oversee the association’s outside counsel
Prepare comment letters on proposed regulations and guidance
Supervise a growing department of 3 FTEs
Develop and manage the Department’s budget.
Work closely with the President/CEO, Leadership Team, and 340B Health’s Board of Directors
Perform all other duties as directed by the President/CEO necessary for the professional discharge of association responsibilities
At least 10-15 years of health care legal or policy experience, preferably representing hospital interests, or the interests of other types of providers. Juris Doctor (JD) degree is required. The candidate should have experience with Medicare, Medicaid, administrative law, hospital and pharmaceutical issues, and the legal/regulatory process. Knowledge of the 340B drug discount program is preferred. The candidate should be a polished public speaker with excellent oral and written communications skills. The candidate must be detail-oriented, and have the ability to manage and prioritize multiple tasks. Some travel is required to industry conferences and organizational roundtables. Attendance is mandatory at bi-annual national conferences in Washington, DC and California.
